WAIVER of LIABILITY:
I certify that I am at least 21 years of age and attest that my physical condition is adequate to safely participate in an Up the Creek Ski and Recreation Club (herein referred to as “UTC”) event/trip/activity in which I choose to participate. In consideration of UTC permitting me to participate in club activities, I agree that I will not sue, or otherwise make any claim against, UTC or any of its officers, directors, agents, trip leaders, members, or volunteers for death, injuries, loss, or damage to persons or property resulting from the negligence or other acts, however caused, by any officer, director, agent, trip leader, member, or volunteer of UTC as the result of my participation in any UTC related activities, including sports, social activities, and all transportation incident to such activities related to UTC. I also hereby release and discharge UTC, its officers, directors, officers, agents, trip leaders, members, or volunteers from all action, claims, or demands for myself, my heirs, or personal representatives for death, injury, loss, damage to persons or property resulting from my participation in any UTC activities including sports, social activities, and all transportation incidents to any UTC related activities, unless such death, injury, personal damage, or property damage results from willful conduct. The terms of this release shall also be binding to any other persons or members of my family, including any minors who may accompany me.
Participants also agree and authorize UTC to take photographs, audio tapes and/or videotapes of them at this event and to display or utilize such photographs, audio tapes and/or videotapes at Club Meetings, in Club publications and member materials and in any advertisements or solicitations whether directed to existing or future Members or to specific individuals or group of individuals via any medium, including print, radio, television, Internet and telephonic means. All Participants hereby release UTC from all liability for any such use or publication.
I HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND UTC AND ITS OFFICERS, DIRECTORS, AGENTS, TRIP LEADERS, MEMBERS, AND VOLUNTEERS, AND I SIGN IT OF MY OWN FREE WILL.

EVENTS/TRIPS/ACTIVITIES
Up the Creek Ski and Recreation Club (“UTC”) has a No Refund Policy for events/trips/activities.
Exceptions to this policy are granted as follows:
- Medical/injury or death: A personal medical or injury to you with a doctor’s involvement; death in the immediate family (parents, siblings, children, and grandparents. NOTE: Pets DO NOT count). The registrant cancelling must be able to provide relevant documentation to substantiate a medical condition, injury or death in family, to obtain a full cancellation refund.
- The trip is cancelled: In some circumstances a trip will be cancelled for all registrants. NOTE: If the venue cancels the trip then UTC must receive its refund from the venue before they can issue refunds.
- Someone cancels for any other reason: In this case an exception is granted ONLY if the cancelled spot is filled. In the case where a cancelled spot is filled, a service charge is applied against the refund based on the price of the trip as follows: Trip value $500 and up: $100 cancellation fee; trip value $200 - $499: $50 cancellation fee; trip value $199 or less: $25 cancellation fee.
- 7 days prior to a trip start date: If you cancel in the 7 days prior to the trip start date, ONLY medical/death/injury cancellations will be eligible for refund. Documentation must be supplied to the Trip Leader to qualify for a refund.
You MUST go through your trip leader/host to cancel and seek reimbursement. If you meet the refund requirements UTC will refund the credit card used for trip/event payment for the amount that you paid minus any applicable service fee. Please allow up to thirty (30) days from the event/trip/activity end date for any refund checks, credit card refunds or comps to be issued. Cancellations are typically processed in the order received.
- Please let your Trip Leader(s) know As Soon As Possible if you need to cancel.
- Under no circumstances may a participant advertise their trip for sale.
- Only your Trip Leader/Host can fill your spot.
DAY BUS
If you sign up and pay for a day bus and you can't make it for any reason, please call, email, or text the bus leader to cancel and UtC will transfer your payment to a day bus on a different day. Please give the trip leaders as much notice as possible and UtC will do its best to accommodate you. If you are sick with a cold or flu, we do not want you on the bus! You can call, text, or email the bus leader to cancel for sickness as late as 6 A.M. the day of the bus trip. You must contact the Trip Leaders to get credit for that day bus. Simple “No Shows” will forfeit their payment.
UTC’s policy is to hold ski bus refunds until the end of the ski season. Therefore, if you have paid for a day bus and you can not make it, or if the bus is cancelled, UTC will hold your payment for another current ski season day bus. At the end of the ski bus season, any individuals with any outstanding day bus credits will be issued a refund check or credit back to your credit card.
EVENTS/TRIPS/ACTIVITIES POLICY
ROOMMATE DISCLAIMER
- Double Occupancy: This is standard on most trips.
- Rooming Requests: UTC attempts to honor roommate and rooming requests, but they are not guaranteed.
- Final Room Assignments: When attending an UTC trip, participants must keep to the room and bed assignments the trip leader has provided. Final room assignments are at the trip leader(s) discretion as room assignment changes may be required up to the time of trip departure. In some instances, trip participants may be assigned to room with a person they do not know, or may have to share a bed with a person they do not know of the same sex.
- Single Occupancy: If you do not wish to share a room or bed, single rooms may be available at additional cost. Please sign up for single occupancy when you sign up for the trip in the beginning. There may be instances when a trip participant must pay for single occupancy in order to go on the trip.
- Questions or Concerns: Please check with the trip leader(s) for more information. If for some reason when the accommodations are different from expected or unacceptable, please work with the trip leaders to resolve the issue. Please do not take the issue into your own hands and do not move into the unit
CODE OF CONDUCT

Guests: Guests are not permitted without the prior approval of the trip leader and must include appropriate payment. Under no circumstances may a participant invite someone to stay in a unit without the permission of the trip leader. Any banned club members are not allowed in the rooms, condos, vehicles, or other club rented facilities.
- Trip Party: On some trips, a party room is provided to UTC. Non-trip persons may not attend a party without the prior permission of the trip leader. An appropriate fee will be assessed. Given that the party room is occupied by people that desire a good night's sleep and have activities scheduled, the party shall end at a reasonable time.

Noise: It is a certainty that we will be sharing the hotel/condo with non-UTC people. Many of them may have small children and may not share our enthusiasm for late night libations. Please be considerate! Move yourself and your bags into your room as quietly as possible. Talking loudly (or any other activity that makes noise) in the hallways is NOT permitted! If you are getting a group together to go out, assemble the group in a room or outside the building.

Quiet Hours: Although the majority of trip participants rise early to go skiing/hiking, there are also people who are on the trip primarily to relax. Please be respectful of your roommates and condo mates and limit noise between 10 PM and 6 AM.

Bathrooms: When possible the club makes every effort to have at most two people per bathroom. People should always use good judgment and use the bathroom most accessible to their bedroom.

Rides: On events where there is no bus, every member participant is responsible for finding their own ride transportation.

Last of all: Constructive suggestions are welcome. Participants need to remember that trip leaders are volunteers and most have full-time jobs. So please be patient with the trip leaders.
By signing up or attending any UTC event/trip/activity and by paying the fees, you agree to conduct yourself in accordance with the UTC “Waiver of Liability and Terms of Participation”. Failure to do so may result in being banned from future Up The Creek trips, and in serious cases, from Up The Creek.
MEMBERSHIP POLICY
If purchasing a club membership, I certify that I am at least 21 years of age and attest that my physical condition is adequate to safely participate in an Up the Creek Ski and Recreation Club (herein referred to as “UTC”) event/trip/activity in which I choose to participate. I agree to adhere to the UtC rules and “Waiver of Liability and Terms of Participation”. If I receive comps for volunteering, I realize my comps cannot be sold or transferred. My comps can be used for my membership dues. If I do not renew my membership then after two years my comps will be dissolved.
